1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Rong Kimvuong (“Company,” “we,” “us,” or “our”), concerning your access to and use of the Rong Kimvuong platform, algorithmic execution software, artificial intelligence indicators, and digital analytical services (collectively, the “Services”).
By registering an account, connecting third-party broker interfaces, or interacting with our automated trading bots, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with any part of these Terms, you are expressly prohibited from using the platform and must discontinue access immediately.
2. Eligibility and Jurisdiction
To register and utilize the Services, you must be an individual of at least 18 years of age or possess the requisite legal capacity under the laws applicable in the United Kingdom or your jurisdiction of habitual residence. By using the platform, you represent and warrant that your access does not breach any domestic or international statutory restrictions, economic sanctions, or digital asset directives applicable to your person or entity.
Rong Kimvuong does not offer its services to residents of sanctioned territories or jurisdictions where automated crypto asset execution, derivatives indexing, or algorithmic financial software are restricted by local legal statutes.
3. Nature of the Service & No Financial Advice
Rong Kimvuong provides algorithmic software suites, predictive signal modelling, and automated execution routing interfaces. We operate solely as a technology service provider and software developer.
- No Advisory Capacity: Rong Kimvuong is not an authorized financial adviser, discretionary asset manager, credit institution, or investment intermediary.
- Educational & Computational Nature: All metrics, automated backtests, calculators, indicators, and model performance charts generated by the platform are purely mathematical computations meant for educational and operational automation purposes.
- Independent Choice: You retain complete and unshared discretion over every algorithmic strategy parameter, risk stop-loss limit, leverage multiplier, and capital allocation applied across your linked trading accounts.
4. Account Security and User Obligations
When you create an account, you agree to provide true, accurate, and current operational information. You are solely responsible for maintaining the confidentiality of your platform credentials, API secrets, multi-factor authentication (MFA) devices, and underlying private keys.
You agree to immediately notify Rong Kimvuong of any unauthorized access, compromised API tokens, or systemic security breach. Rong Kimvuong will not be held liable for any loss, misappropriation, or damages resulting from compromised account keys, phishing events, or failure to maintain adequate credential security on your private hardware.
5. Automated Execution, Slippage, and Technical Latency
Our platform facilitates autonomous execution via algorithmic trading bots connecting to decentralized or centralized counterparties. You acknowledge that automated execution carries technical dependencies:
- Latency & Network Congestion: Network delays, node latency, exchange throttling, or blockchain mempool congestion may lead to execution slippage between algorithmic signal dispatch and final order settlement.
- System Outages: Unplanned maintenance, network downtimes, server restarts, or API updates by third-party brokerages may disrupt continuous trading routines.
- No Execution Guarantee: Rong Kimvuong does not guarantee that orders will be matched, fulfilled at requested limits, or executed without slippage during high-volatility market events.
6. Intellectual Property Rights
All intellectual property, proprietary source code, algorithmic neural networks, user interface designs, trademarks, logos, and mathematical formulas incorporated in Rong Kimvuong belong entirely to the Company and its licensors. You are granted a revocable, non-exclusive, non-transferable, limited licence to use the Services for personal or sanctioned business execution. Reverse-engineering, decompiling, distributing, scraping, or reselling platform architecture without express written permission is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted under applicable law, in no event shall Rong Kimvuong, its directors, officers, employees, affiliates, or technology partners be liable for any direct, indirect, consequential, exemplary, incidental, or special damages, including lost profits, loss of trading capital, balance liquidation, missed trading opportunities, or business interruption arising out of your utilization of, or inability to utilize, the platform.
Your exclusive remedy in the event of any operational defect, server outage, or functional grievance is to discontinue using the platform and terminate your registered subscription.
8. Amendments and Termination
We reserve the right to revise, update, or amend these Terms at our discretion. Material modifications will be indicated by an updated timestamp at the head of this page. Continued interaction with the platform following the publication of changes signifies your definitive acceptance of revised terms.
We reserve the immediate right to suspend, limit, or terminate user access without prior notice if we detect abusive activity, API spamming, illicit financial manipulation, fraudulent identity usage, or breaches of this agreement.
9. Governing Law and Dispute Resolution
These Terms, their interpretation, and any non-contractual obligations or claims arising out of them shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any unresolved disputes arising in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the United Kingdom.
